If there is a guardian listed in the will, who will have the custody of the kids once one parent passes?
If there is a guardian listed in the will, who will have the custody of the kids once one parent passes?
By way of general comment, upon death of one spouse the guardianship goes directly to the surviving spouse automatically. The child guardianship clause of the Will only activates when there are no legal guardians around.
