Do you need to identify the property in a bare trust under a limited recourse borrowing arrangment?
The bare trust deed needs to identify the property as section 67A requires an identification of the single acquirable asset. If you don't know the property at the time, create the trust and then when it is know relaunch the document and insert the asset.
Please be advised this is general information only, and is not to be taken as legal advice. If you would like more information, or have a legal query, please contact Abbott & Mourly directly.
