How does the Trustee ensure that the Leading Member acts in the best interest of the Fund?
The Trustee is required to act in the best interests of all the members of the Fund. Although a Leading Member has power to limit membership, at the end of the day the Leading Member is always a Trustee of the Fund and must abide by the best interests duty for superannuation trustees.
